Congratulations! We’re so happy you’ve chosen to join us at the Awakener Live Event in San Diego March 4th and March 5th 2023! You’re about to create a whole new reality for you and inspire all those around you - and we're SUPER EXCITED for you! Our aim and intention is for this to be an incredibly exhilarating, soul opening, beautiful and empowering experience for you! Working closely together with you, and our necessary vendors as a team to make this the best possible experience for all involved is our main desire :)

To ensure this as best we can - this is a legal and binding agreement between Jennifer Spencer referred to as “Jennifer Jayde”, Jennifer Jayde International Inc (“JJI”), owner of the Awakener Live Event - and the purchaser of the ticket to attend the Awakener Live Event with Jennifer Jayde.

GENERAL

By registering for our Awakener Live Event and Programme you warrant that:

- You are legally capable of entering into binding contracts; and

- You are at least 18 years old; and

- That all information you provide us with is materially true and accurate at all times and not misleading in any way.

Due to your purchase being a coaching package/event in a personal and business capacity, we do not offer refunds or cancellations. All contracts and purchases are binding.

All payments are non-refundable.

PROGRAM DETAILS

The Awakener Live Event will be delivered in Person in San Diego as described on the event webpage.

This is a 2 day live in-person event with the potential for optional complimentary social gatherings the night before the event begins, as well as the evening of the first day or second day.

Please dress completely comfortably. This can be yoga pants, leggings, anything that you feel most relaxed in and can sit/move comfortably in throughout the day. Please bring a sweater or layers to adjust your own temperature comfort.

Please note you are responsible for your transportation to and from the live event, as well as to and from these optional social gatherings or complimentary added bonuses. JJI nor Jennifer Jayde take any liability for your chosen mode of transportation.

You are not required to bring anything to the live event, however a journal and pen, sweater, water and snacks, and anything else that will make your experience more enjoyable or comfortable are recommended.

Refreshments with Gluten Free, Vegetarian, and Dairy friendly options will be provided by a 3rd party, and we do not hold any responsibility for the actions of said 3rd party, nor can we confirm the food is prepared in strict enough standards for any serious allergies. Please make your own lunch arrangements if you have intolerances outside the 3 mentioned, or severe allergies that require stricter preparation.

The venue is also being provided by a 3rd party, and because of this, we can not be held liable for anything that happens outside of our control where this 3rd party is concerned.

Should anything unexpected occur, Jennifer Jayde will make every effort to make alternate arrangements and keep the event and details as close to the original plan as possible.

You will have full access to the Awakener Live Event and everything included in accordance with the description on the event web page. Jennifer Jayde reserves the right to shift or alter the schedule or trainings at her sole discretion.

OBLIGATIONS

We warrant you that the program materials purchased from us is of satisfactory quality and reasonably fit for the purpose for which the program is supplied. You acknowledge and agree that your personal data will be processed by and on behalf of us as part of us providing the program to you. Jennifer Spencer and Jennifer Jayde International Inc. are owners of all the intellectual property rights and all rights in the program and all content within the program and nothing in these terms or otherwise shall operate to transfer the ownership of the intellectual property rights in the program or the content of the program to you or any other person. You may not at any time copy, reproduce, publish in any form, share, sell, dispose of or otherwise make available to a third party in any way of the content or materials contained in the program. Unauthorized use of course content will be penalized with a $50,000USD fine.

PAYMENT

The total price payable for the program is non-refundable.

If you registered i) an instalment plan - final payment is due in full at minimum 30 days before the event takes place. Should any payments still be outstanding beyond this point, it is up to Jennifer Jayde's sole discretion as to whether or not your space will continue to be held, or given/sold to the next person in line. Any previously made payments by you will be forfeited as part of breaking this contract, regardless of whether or not the space gets filled.

If any sum payable under these terms is not paid within 3 days of the due date (as described upon registration), Jennifer Spencer and Jennifer Jayde International Inc. reserve the right to (i) charge interest from the date due for payment to the actual date of payment at the rate of 3% above the base rate of HSBC from time to time in force and/or (ii) suspend the availability of the Programme until such time as payment is made or the Contract is terminated, and/or iii) Terminate the contract resulting in forfeiture of previously paid instalments by the client and the reselling of this space to another potential registrant.

We reserve the right to report failure to pay or NSF chargebacks to credit reporting bureaus, and send your account to collections. You also agree to reimburse any NSF fees incurred by Jennifer Jayde International Inc. in addition to the payment due.

ii) If you registered by paying in full, due to your purchase being a coaching package/event in a personal and business capacity, we do not offer refunds or cancellations. All contracts and purchases are binding.

All payments are non-refundable.

**However, you do have the ability to transfer your ticket should an emergency arise where you become unable to attend the event up to 3 weeks before the event takes place** Please contact info@jenniferjayde.com for further instruction/details if needed.
***Also - if there are changes in Travel Restrictions AFTER you book and register for your ticket that legally prevent you from being able to attend in-person, JJI will 100% refund your ticket fee within 90 days (or sooner) of the event taking place. Note that you are responsible for knowing any current travel restrictions already in place prior to booking and paying for your ticket. Refunds will not be issued for travel restrictions already in place at the time of booking.

COMMUNICATION

You accept that communication with Jennifer Jayde, the Awakener Live Event and it’s members will be mainly in person or electronic. We will contact you by email or provide you with information by posting notices via the membership site and/or temporary private community Facebook group for the Awakener Live Event. You agree to this electronic means of communication and acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any written requirement that such communications be in writing.

DISPUTE RESOLUTION

Canadian Federal and British Columbia law applies. In the case of lawsuit, Jennifer Spencer and Jennifer Jayde International Inc. attorney's fees will be covered by you and you agree to be sued near Jennifer Spencer’s Canadian address.

TERMS AND TERMINATION

We reserve the right to terminate the contract due to serious or repeated breach or non-observance of any of the provision of these terms. You agree that the contract constitutes the entire agreement and understanding between us and supersedes any previous arrangement, understanding or agreement between us relating to the provision of the program. We may vary these terms (other than the price payable by you for the program) as we see fit. If we do, we will notify you by email of the change of terms. Your continuation with the program will be deemed to be your acceptance of any new terms. Upon failure to uphold this agreement, all payments are immediately due in full because all the content has been released in full.

BONUSES

If you join the Awakener Live Event within any kind of specified bonus time frame, these bonuses will be delivered immediately via email. Jennifer Jayde reserves the right to add extra bonuses, or remove outdated/obsolete ones at her sole discretion.

RECORDINGS

You may take photos or record audio/video clips for your own personal, private, individual use. Any other use or sharing with others will be deemed a misuse of Intellectual Property and legal action may be taken. Please do not use photos, videos or audios from our event to promote your event or business without the express written approval of Jennifer Jayde International Inc, and the photographer who took them.

ADDITIONAL AGREEMENTS

While we'll make every effort on our part to create this space for you and with you - You are ultimately 100% responsible for your self, your enjoyment, and your results. Please come with an open mind and heart, and be willing, ready and open to expanding, enjoying, learning and co-creating.

In order to keep the cost as accessible as possible for the Awakener Live Event - You are free to choose (and are responsible for) your travel to and from San Diego, travel to and from the live event location, your meals (light lunch is included Day 1 and Day 2), and your sleeping arrangements. If you're coming from out of town, feel free to ask us for nearby hotel accommodations, or feel free to check out Airbnb as well. You must notify us immediately if you become aware of any misuse of content.

You agree to keep user details and your password for the site confidential at all times and to not disclose them to any third party.

You authorize us to use your image and words without payment or consent.

You are not permitted to sell or promote products or services to other participants in the program or during any part of our program without prior written permission.

Jennifer Spencer and Jennifer Jayde International Inc. are permitted to share any content from the calls, event, as well as from the Facebook group.

LIABILITY

We shall not be liable for any loss of profits, loss of business, depletion of goodwill and/or similar losses, loss of anticipated savings, loss of goods, loss of contract, loss of corruption of data or information or any special, indirect, consequential or pure economic loss, costs, damages, charges, or expenses suffered or incurred by you as a result of you entering into the contract and/or us providing the program.

If we are prevented from or delayed in performing our obligations by your act or omission or, by any circumstance outside our control, we shall not be liable to you for any costs, charges or losses sustained or incurred by you that arise directly or indirectly from such prevention or delay.

By purchasing a ticket/registering to attend this event - you enter into agreement that attending this live, in-person event is of your own free will and at your own risk.

GUARANTEES

You recognize that Jennifer Spencer and Jennifer Jayde International Inc. will always have your best interest at heart and that with hard work and an open mind, you can make life-changing strides in your life towards your goals. However, as with anything in life, there are no guarantees and your success is dependent on your effort outside of the Awakening Live Event as well.
